three (3) important time frames to consider
When thinking about defects in construction, standards and tolerances, there are three key time periods determine which standards apply:
- 6-Month Defects Liability Period – Applies from the date of handover.
- 12 Months from Completion – Covers non-structural defects.
- 6 Years and 3 Months from Completion – Covers structural defects.
Applicable Timeframes for Defective Work
- Non-structural defects are generally covered for 12 months from completion.
- Structural defects fall under a 6-year and 6-month coverage period.
Defining the Date of Completion
The completion date is typically:
- When the work under the contract has been finished according to its terms, or
- When the building owner receives the statutory permit or certificate of occupancy.
Claiming Under the Home Warranty Scheme
For non-structural defects, you must:
- Identify the defect within 6 months of completion.
- Lodge a claim within 7 months to be eligible for coverage under the Home Warranty Scheme.
Builders might not mention this unless you ask after handover, which is why I believe it's important for you to know this information upfront to manage the risk effectively.
